1. About fogr.ai

fogr.ai is an online classifieds platform that allows users to publish advertisements and communicate with other users. fogr.ai acts solely as an intermediary hosting service and does not sell, buy, inspect, guarantee, deliver, or endorse any items or services listed on the platform.

fogr.ai is operated from Ireland and is intended primarily for users in Ireland.

2. Eligibility

  • You must be at least 18 years old to create an account or post an advertisement.
  • By using fogr.ai, you confirm that you meet this requirement.
  • We may suspend or delete accounts where age eligibility is in doubt.

We record limited technical information (including account ID, timestamp, and IP address) to support compliance and abuse prevention.

3. Accounts

  • Accounts are created using email-based authentication.
  • You are responsible for all activity under your account.
  • You must keep your access secure and notify us of any unauthorized use.

We may introduce additional verification methods (such as phone or identity verification) in the future. Where introduced, these will be optional unless otherwise stated.

4. Listings and User Content

4.1 Your responsibility

You are solely responsible for the content you post, including:

  • accuracy and legality of listings,
  • compliance with applicable laws,
  • ensuring you have the right to post text or images.

4.2 Automated checks

Before publication, listings are subject to automated content checks designed to detect prohibited or harmful content. Listings that pass these checks are published immediately.

Automated systems do not make final legal determinations.

4.3 Prohibited content

You may not post content that is illegal, misleading, abusive, fraudulent, or otherwise prohibited under Irish, EU, or UK law.

We may maintain category-specific rules and remove content that violates them.

5. Platform Role and Transactions

  • fogr.ai does not participate in transactions between users.
  • All interactions, negotiations, and exchanges occur solely between users.
  • fogr.ai is not responsible for payments, delivery, quality, safety, or legality of items or services.

Any disputes must be resolved directly between users.

6. Messaging

  • fogr.ai provides in-app messaging linked to listings.
  • User names, email addresses, and phone numbers are not displayed by default.
  • Users may voluntarily share personal details at their own discretion.

fogr.ai is not responsible for communications shared voluntarily between users.

7. Reports, Moderation, and Appeals (DSA)

7.1 Reporting content

Users may report content they believe is illegal or violates these Terms using the reporting tools on the platform.

7.2 Moderation actions

We may remove content or restrict accounts where necessary to:

  • comply with the law,
  • enforce these Terms,
  • prevent harm or abuse.

7.3 Statement of reasons

Where content is removed or an account is restricted, affected users will receive a statement of reasons explaining:

  • the decision,
  • whether it was automated or human-reviewed,
  • available appeal options.

7.4 Appeals

Ad owners may appeal moderation decisions using the appeal process provided. Reporters may track report status using their report reference.

8. Paid Features (Future)

fogr.ai currently offers free listings. Paid features may be introduced.

Where paid features are offered:

  • fogr.ai will be the provider of the digital service.
  • users may be required to expressly consent to immediate service delivery.

If you request immediate performance of a paid service, you acknowledge that your statutory right of withdrawal may be lost once the service has been fully performed, in accordance with EU consumer law.

9. Traders and Business Users (Future)

fogr.ai may allow business sellers ("traders") to post listings in the future.

Where applicable:

  • traders may be required to identify themselves as businesses,
  • additional consumer information obligations may apply,
  • fogr.ai may display trader status to users.

10. Intellectual Property

  • You retain ownership of content you post.
  • By posting content, you grant fogr.ai a non-exclusive, royalty-free, worldwide licence to host, display, and distribute it for platform operation.

We may remove content that infringes intellectual property rights. Repeat infringers may have their accounts restricted or terminated.

11. Account Suspension and Termination

We may suspend or terminate accounts that:

  • violate these Terms,
  • repeatedly post prohibited content,
  • misuse the platform.

We may also suspend accounts to comply with legal obligations.

12. Data Protection

Our use of personal data is explained in the Privacy Policy, which forms part of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Ireland. Courts of Ireland have exclusive jurisdiction, without prejudice to mandatory consumer protections.
